Terms of sale
This is an English translation provided for convenience. The French version is the binding one and prevails in case of discrepancy.
1. Seller
Newphonia Song is a service marketed by Newphonia Records (see the legal notice of Newphonia Records, which applies to this service). Contact: contact@newphonia-records.com.
2. Purpose
Newphonia Song allows the customer to have a unique song (the "Song") written and produced from the information they provide in the online studio (the occasion, the recipient, anecdotes, style), with the help of an AI-assisted Artistic Director and a production team. These terms govern every order placed on app.newphonia-song.com.
3. Price and payment
The price is €29 incl. VAT, payable in one instalment by bank card via Stripe at the time of the order. Payment opens access to the creation studio. No subscription is taken out.
4. What is included
- A guided brief, a theme and lyrics co-written with the Artistic Director; up to three full rewrites of the lyrics.
- Production of the Song by the studio, sung by a studio voice (or by the customer if they choose to record their own voice), delivered in two versions to choose from; one re-production (two additional versions) if needed.
- An illustrated cover (two proposals), with or without a photo supplied by the customer.
- Delivery of an MP3 audio file and an MP4 video (still cover and sound), downloadable, plus a permanent sharing link.
Indicative timings: brief and writing live; production in a few minutes. Beyond the included iterations, the Newphonia team takes over and may offer an additional service.
5. Right of withdrawal
The Song is personalised digital content made to the customer's specifications. By confirming the order, the customer expressly requests that performance begin before the end of the fourteen-day withdrawal period and acknowledges losing the right of withdrawal as soon as performance begins (Articles L221-25 and L221-28 of the French Consumer Code).
6. Intellectual property and permitted use
Copyright and related rights in the Song (lyrics, composition, recording, cover) remain the exclusive property of Newphonia Song / Newphonia Records. The customer receives a personal, non-exclusive, non-transferable licence of unlimited duration for strictly private use: listening to the Song, giving it as a gift, playing it in a family or friendly setting (party, private ceremony), sharing it with loved ones via the sharing link or the delivered files.
The following are prohibited without prior written consent: any upload to streaming or download platforms (Spotify, Apple Music, Deezer, YouTube Music, etc.), any distribution on social networks for monetisation purposes, any radio or television broadcast, any commercial, advertising or professional use, and any modification, remix or resale of the Song. Newphonia Records reserves the right to have any unauthorised use taken down.
7. Information supplied by the customer
The customer warrants that they hold the necessary rights to the information, texts and photos they supply, and that they have the consent of the persons concerned (in particular for the use of a photo on the cover). Newphonia reserves the right to refuse unlawful, defamatory or indecent content, with a refund of the order.
8. Personal data
Data is processed to fulfil the order and manage the account, in accordance with the Newphonia Records privacy policy. The customer has the right to access, rectify and delete their data by writing to contact@newphonia-records.com.
9. Disputes
These terms are governed by French law. In the event of a dispute, the customer may use a consumer mediator free of charge. Failing an amicable settlement, the French courts have jurisdiction.
